Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of MyFrame websites, online stores, mobile applications, downloadable software that accompanies our products, customer support offerings, and connected MyFrame devices that operate with those services (collectively, the “Services”). By purchasing, downloading, installing, registering an account where available, browsing our sites, or otherwise using the Services, you agree to these Terms.

If you are entering into these Terms on behalf of a company, household, school, or other entity, you represent that you have authority to bind that entity and “you” will refer to that entity and its authorized users.

Our Privacy Policy explains how we collect and use personal information. The Privacy Policy is incorporated by reference into these Terms.

Eligibility and accounts

You must be able to form a legally binding contract in your jurisdiction to use the purchasing portions of the Services. If account registration exists for your product, you agree to provide accurate, current information and to keep credentials secure. You are responsible for activity under your account unless caused solely by our negligence.

You may not share credentials in ways that circumvent limits on authorized users, impersonate others, or attempt to probe, scan, or test the vulnerability of the Services without written permission.

Changes to the Services and these Terms

We may modify the Services or these Terms over time, including for security, legal, operational, or product reasons. When we update these Terms, we will post the revised version on this page and update the effective date. If changes are material, we may provide additional notice as permitted by law. Continued use after the effective date of changes constitutes acceptance of the revised Terms, except where applicable law requires a different consent mechanism.

Products, availability, and descriptions

MyFrame designs and sells connected family photo frame hardware and provides supporting software for pairing, synchronization, content management, and customer support.

We strive to present accurate descriptions, images, specifications, and compatibility data. However, electronics products evolve, regional SKUs may differ, and materials may be updated. Packaging or bezels may differ slightly from photographs. Specifications such as display technologies, connectivity options, battery expectations, supported formats, and invited-member limits may vary by model and firmware version. If a critical specification affects your purchase decision, confirm in checkout details or contact support before ordering.

Product availability, pricing, promotions, bundles, and shipping methods may change without prior notice except where a confirmed paid order already exists subject to the cancellation rules below.

Orders, pricing, taxes, and acceptance

When you place an order, you make an offer to purchase. We may accept or decline orders for operational, fraud-prevention, inventory, export-control, or reliability reasons. A contract is formed when we confirm acceptance, for example by sending an order confirmation email or beginning fulfillment, consistent with the practices stated in checkout.

Prices are shown in the currency selected where supported. You are responsible for applicable taxes, duties, import fees, or carrier charges that depend on your destination. Displayed totals may include estimates; final amounts are those shown at payment confirmation.

If we discover a clear pricing error that no reasonable customer would expect, we may cancel the order and refund any payment captured, or offer to re-issue at corrected pricing where lawful.

Shipping and delivery

Delivery dates and transit times are estimates and are not guaranteed. Delays may occur due to customs inspections, carrier capacity, weather, holidays, incomplete addresses, remote locations, or events outside our reasonable control. Title and risk of loss pass according to the incoterm or carrier terms shown in your shipment workflow where applicable.

You are responsible for providing a deliverable address and for complying with import rules in your country. If a shipment is returned because of an incorrect address or failure to receive, additional fees may apply for re-shipment.

Payments and fraud prevention

Supported payment methods may include credit and debit card processing, PayPal, or other providers shown at checkout. Payment processing is performed by third parties. You authorize us and our payment providers to charge your selected method for the authorized amount.

You represent that you are authorized to use the payment method. We may use fraud screening tools, verify identity, delay fulfillment, or cancel suspicious transactions. If a chargeback or dispute is filed, we may suspend fulfillment, close accounts linked to abuse, or pursue lawful remedies.

Returns, refunds, exchanges, and cancellations

Return eligibility depends on product condition, time window, regional law, and the policies communicated at purchase. Unless a longer period is required by mandatory local consumer law, hardware must generally be returned in original condition with included accessories where reasonably possible.

To start a return or exchange, contact support with your order number and reason. Do not ship high-value items without instructions; unauthorized returns may be rejected or delayed.

Digital items or prepaid shipping labels may be governed by separate rules where applicable. If you cancel before fulfillment begins where cancellation is supported, we will refund the purchase payment as permitted by your payment provider.

Software license and updates

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use MyFrame software provided for your personal or authorized household use, solely in connection with genuine MyFrame hardware or services we provide.

You may not copy, modify, reverse engineer, decompile, or create derivative works from our software except where mandatory law permits; rent, lease, sell, or sublicense the software; or remove proprietary notices.

We may deploy automatic updates to apps, firmware, or configuration to maintain security, fix defects, or improve features. Some updates may be required for continued safe use.

User content and acceptable use

You retain ownership of photos and other content you upload, subject to the license below. You represent that you have rights and, where needed, consent to share that content through the Services.

You grant MyFrame a worldwide, royalty-free license to host, store, reproduce, transmit, adapt format, resize, display on authorized devices, and create backup copies as reasonably necessary to operate, secure, improve, and support the Services you choose to use. The license ends when you delete the content and our systems complete deletion, except where retention is required by law or permitted technical backup windows.

You may not use the Services to upload unlawful, defamatory, harassing, hateful, exploitative, or infringing content, or content that violates third-party privacy. You may not use the Services to spam, phish, distribute malware, interfere with servers, scrape our sites in ways that degrade performance, or attempt unauthorized access.

We may remove content or suspend accounts when we reasonably believe these rules are violated or when required by law.

Subscriptions and fees

MyFrame’s public messaging emphasizes no required monthly subscription for normal family photo frame use. If optional subscription features are introduced, they will be presented with clear pricing and renewal rules before purchase.

Warranty and disclaimers

If a limited warranty applies to your product, its terms are provided with the device or in support documentation. Unless required by law, we disclaim all other warranties to the maximum extent permitted, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Warranty coverage typically excludes misuse, unauthorized repair, accidental damage, exposure to liquids, use with incompatible power supplies, cosmetic wear not affecting function, and damage from external events.

Limitation of liability

To the fullest extent permitted by applicable law, MyFrame and its affiliates, directors, employees, and suppliers shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Services, even if we have been advised of the possibility.

To the fullest extent permitted by law, our aggregate liability for claims arising out of or relating to the Services or any order shall not exceed the greater of (a) the amount you paid to MyFrame for the specific product or service giving rise to the claim during the six months before the claim, or (b) one hundred U.S. dollars (US$100), if no purchase amount applies.

Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the minimum permitted amount.

Indemnity

You agree to indemnify and hold harmless MyFrame and its affiliates from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your misuse of the Services, your violation of these Terms, or your violation of third-party rights.

Dispute resolution and governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, excluding conflict-of-law rules that would choose another jurisdiction’s law, unless mandatory consumer law requires otherwise for you.

Subject to non-waivable rights you may have in your home jurisdiction, you agree that courts located in Hong Kong have exclusive jurisdiction over disputes, unless applicable law requires a different venue for consumers.

If you are a consumer in a region that requires a different dispute process, that mandatory process still applies.

Export controls

You may not export, re-export, or transfer our products or technical data in violation of export control laws, sanctions, or embargoes.

Termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, or if we discontinue the Services where permitted. Provisions that by nature should survive termination shall survive, including license limits, warranty disclaimers, limitations of liability, indemnity, and dispute terms.

Miscellaneous

These Terms constitute the entire agreement between you and MyFrame regarding the Services and supersede prior oral or written understandings on the same subject. If any provision is invalid, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.
